Lung Cancer on Long Island
Have you been diagnosed with lung cancer and lived or worked on Long Island?
If you or a loved one has been diagnosed with lung cancer and you spent time working in construction, at a power plant, shipyard, hospital, school, or in older buildings on Long Island, asbestos exposure may be a possible cause. At MiglioreLaw we help people investigate
whether past asbestos exposure played a role in their diagnosis and pursue compensation when negligent employers, product manufacturers, or property owners failed to warn or protect them. Many clients are not aware that they may of been exposed to asbestos before a comprehensive review. We offer free case evaluations and high-quality representation alongside a nationwide network of co-counsel. Call us at 631-543-3663 or contact us online to discuss your situation.
What asbestos is and how it causes lung cancer
Asbestos is a group of naturally occurring minerals that was widely used for insulation, fireproofing, brake linings, pipe insulation, and many other industrial and building products. When asbestos fibers are disturbed they become airborne and can be inhaled. Over many years, those fibers can damage lung tissue and lead to serious diseases — including lung cancer and malignant mesothelioma. Asbestos-related diseases often take decades to appear after exposure. CDC Archive
Common ways Long Islanders were exposed
On Long Island — as across the country — asbestos exposure most often happened in workplaces and buildings where asbestos-containing materials were installed, repaired, or removed. Typical exposure scenarios include:
- Construction, renovation, demolition, and maintenance work on older buildings
- Power plants, boilers, and industrial facilities where insulation and gaskets contained asbestos
- Shipyards and maritime trades (repairing or working on ships)
- Tradespeople: pipefitters, electricians, HVAC workers, machinists, boiler operators, and laborers
- Schools, hospitals, municipal buildings, and older multi-family homes with original asbestos materials
If you spent time working or where in these settings for other reasons on Long Island, it’s important to tell us about the places and employers where you worked — even if the exposure happened many years ago.
Symptoms, diagnosis, and the long latency period
Asbestos-related lung disease can present like other lung conditions — cough, shortness of breath, chest pain, wheeze, or unexplained weight loss. Because asbestos diseases often have a long latency period (commonly 10–40 years or more from first exposure to diagnosis), many people do not realize their cancer could be related to asbestos until late in life. If you’re experiencing respiratory symptoms and have a history of occupational or household exposure, prompt medical evaluation and a careful exposure history are essential. CDC Archive, CDC MMRW
Important deadlines — act now
Time limits (statutes of limitations) in New York are critical and can bar a claim if you wait too long. Under New York law, most personal injury claims must be brought within three years, and wrongful death claims generally must be brought within two years from the date of death. For illnesses caused by latent exposure to a harmful substance (like asbestos), New York’s discovery rule means that the three-year period is typically measured from the date the injury (or disease) was discovered. These rules are complex and include exceptions, so do not assume a deadline has passed without checking with counsel.
