Fighting Traffic Tickets and Traffic Misdemeanors
Sometimes paying a traffic ticket is the simplest thing to do, especially when you know you were guilty of the violation. However, when you believe the ticket is unjust or when your traffic violation is classified as a misdemeanor, it is wise to seek legal help. Also, if your ticket could result in adverse consequences, such as a high number of violation points, you should consult with a lawyer..
The Traffic Violations Point System
The New York State Department of Motor Vehicles (DMV) has a points system in place that assigns a point value to particular traffic violations. If you receive 11 points or more during an 18-month period, the DMV may suspend or revoke your license.
Speeding Violations
Speeding points vary based on the number of miles above the posted speed limit. The following points are for speeds that exceed the posted limits by the mph stated:
- 3 points for 1-10 mph
- 4 points for 11-20 mph
- 6 points for 21-30 mph
- 8 points for 31-40 mph
- 11 points for over 40 mph
Other Moving Violations
Other traffic violations points include:
- 5 points for reckless driving
- 5 points for failure to stop for a school bus
- 5 points for texting while driving
- 4 points for tailgating
- 3 points for disobeying traffic signals, stop signs or yield signs
Traffic Misdemeanors
Certain traffic offenses are misdemeanors. Misdemeanors are crimes and require appearing in court. Examples of misdemeanors are:
- Driving with a suspended license
- Driving with suspended registration
- Reckless driving
While driving without insurance is not a misdemeanor, the consequences can be serious, especially if involved in a car crash. If you are the registered owner of the car, driving without insurance can result in license revocation for one year and a fine of up to $1500. After the year’s revocation is over, you must pay a fee of $750 to get your license back.
Do Not Plead Guilty
Sometimes your attorney can get a traffic ticket dismissed, and this often occurs when a police officer has not submitted adequate documentation. Find out what your options are.
